By accessing or using Seaway Project Cargo's services, website, or any related applications (collectively, the "Services"), you agree to be bound by these Terms of Service. If you do not agree to these terms, please do not use our Services.
2. Description of Services
Seaway Project Cargo provides international and domestic freight forwarding, customs brokerage, project cargo management, and related logistics services for heavy equipment and oversized cargo.
3. User Responsibilities
You agree to:
- Provide accurate and complete information for all shipments
- Comply with all applicable laws and regulations
- Obtain necessary export/import licenses and permits
- Properly declare all cargo contents and values
- Pay all fees and charges in a timely manner
- Not ship prohibited or restricted items
4. Quotations and Pricing
All quotations are estimates based on information provided and are subject to change. Final pricing may vary based on actual cargo specifications, weight, dimensions, and other factors. Quotes are valid for 30 days unless otherwise specified.
5. Payment Terms
- Payment is due according to the terms specified in your contract or invoice
- Late payments may incur interest charges at 1.5% per month
- We reserve the right to hold cargo until payment is received
- All prices are in US Dollars unless otherwise specified
6. Insurance and Liability
We strongly recommend cargo insurance for all shipments. Unless otherwise agreed:
- Our liability is limited to the carrier's standard liability
- We are not liable for delays caused by weather, customs, or force majeure
- Claims must be filed within 9 months of delivery
- Additional insurance is available upon request
7. Cargo Requirements
All cargo must be:
- Properly cleaned and free of soil, seeds, and biological matter
- Adequately prepared for ocean/air transit
- Accurately described with proper documentation
- Legally exportable/importable
8. Prohibited Items
We do not transport:
- Illegal substances or contraband
- Weapons or explosives (without proper licensing)
- Hazardous materials (without proper certification)
- Live animals or perishable goods
- Items prohibited by origin or destination country
9. Intellectual Property
All content on our website, including text, graphics, logos, and software, is the property of Seaway Project Cargo and protected by intellectual property laws.
10. Limitation of Liability
To the maximum extent permitted by law, Seaway Project Cargo shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of our Services.
11. Indemnification
You agree to indemnify and hold harmless Seaway Project Cargo from any claims, damages, or expenses arising from your breach of these Terms or misuse of our Services.
12. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the State of Delaware, without regard to conflict of law principles.
13. Dispute Resolution
Any disputes arising from these Terms shall be resolved through binding arbitration in Dover, Delaware, in accordance with the rules of the American Arbitration Association.

We reserve the right to modify these Terms at any time. Continued use of our Services after changes constitutes acceptance of the modified Terms.
