Terms of Service

These terms apply to your use of this website and to quotes we provide through it. Shipments we handle are also governed by the terms you accept during customer onboarding and by the carrier's bill of lading or air waybill. If those documents conflict with these terms, they take priority for that shipment.

1. Using This Website

By using this website you agree to these terms. If you do not agree, please do not use the site. You agree not to misuse the site, including by submitting false information, sending automated requests, or trying to access areas that are not public.

2. Our Services

Seaway Project Cargo provides international and domestic freight forwarding, project cargo management and related logistics services for heavy equipment and oversized cargo. Customs clearance is arranged through licensed customs brokers.

3. Quotes

• Quotes are based on the information you provide. If the actual dimensions, weight, cargo condition or dates differ, the price may change.
• Quotes are valid for 30 days unless the quote says otherwise, and are subject to space and equipment availability when you book.
• Carrier surcharges, port charges, duties, taxes and storage outside our control may be passed through at cost.
• All prices are in U.S. dollars unless stated otherwise.

4. Your Responsibilities

• Describe your cargo accurately, including its contents, value, dimensions and weight
• Declare any hazardous materials, batteries or fuel
• Make sure the cargo is clean, prepared for transport and legally exportable and importable
• Provide the documents, licenses and permits that apply to your cargo
• Pay invoices on time

5. Prohibited Cargo

We do not handle:

• Illegal goods or contraband
• Weapons, explosives or hazardous materials without the required licenses and documentation
• Live animals or perishable goods
• Anything prohibited by the origin, transit or destination country

6. Payment

• Payment is due according to your invoice or written credit terms.
• Late payments may incur interest of 1.5% per month, or the maximum allowed by law if lower.
• We may hold cargo and documents until outstanding charges are paid.

7. Insurance and Liability

• We strongly recommend cargo insurance on every shipment, and can arrange it on request.
• Unless you buy insurance or we agree otherwise in writing, our liability is limited to the carrier's standard liability.
• We are not liable for delays or losses caused by weather, port congestion, customs holds, strikes or other events beyond our control.
• Claims must be submitted in writing within 9 months of delivery, or within the shorter period set by the carrier's terms.

8. Tracking, Tools and Content

Online tracking, calculators and guides on this site are provided for convenience. They give estimates and general information, not legal, customs or tax advice, and may not reflect the latest status or rules. Confirm important details with our team.

9. Intellectual Property

The content of this website, including text, graphics and logos, belongs to Seaway Project Cargo or its licensors. You may not copy or reuse it without permission, except for the press materials on our Press & Media page.

10. Limitation of Liability

To the extent permitted by law, Seaway Project Cargo is not liable for indirect, incidental, special, consequential or punitive damages arising from your use of this website.

11. Indemnification

You agree to indemnify Seaway Project Cargo against claims, damages and expenses arising from inaccurate cargo information you provide or from your breach of these terms.

12. Governing Law and Disputes

These terms are governed by the laws of the State of Delaware, without regard to conflict of law principles. Disputes will be resolved by binding arbitration in Dover, Delaware, under the rules of the American Arbitration Association.

13. Changes

We may update these terms. Changes apply from the date shown at the top of this page and do not affect shipments already booked.
